An Ikeja Chief Magistrate’s Court, yesterday, remanded a mechanic named Opeloyeru Yusuf, in Kirikiri Prison for allegedly defiling his neighbour’s 11-year-old daughter. The Chief Magistrate, Mr. Tajudeen Elias, adjourned the case to May 16 for hearing on the accused’s bail application.
Opeloyeru Yusuf, 25, who lives at No. 97 Amawo St., Agege, a suburb of Lagos, is standing trial on one-count of defilement for defiling the 11 year old girl. The prosecutor, Insp. Benedict Aigbokhan told the court that the offence was committed on April 17 at the accused’s residence. Inspector Aigbokhan said that Opeloyeru Yusuf sent the girl- who has not been named, to buy food for him and on her return, shut the door to his room and defiled her. During the act, Yusuf allegedly gagged the girl to stop her shouts and screams from alerting neighbours and passersby.
“The accused who is the girl’s neighbour warned the girl not to tell anyone after the act was perpetrated. The girl struggled as most rape victims do and told no one of her plight but when she persistently complained of having severe pain in her private part, she confessed to her aunty,” the prosecutor said.
He said that the offence contravened Section 137 of the Criminal Law of Lagos State which states that any person who has sexual intercourse with a child is guilty of felony and liable to life imprisonment. As the girl is only an 11-year-old who is considered underage according to Nigeria’s law and incapable of giving consent, he should be punished.
